Big Brain, Inc. provides a platform to allow our customers to engage and converse with their end users through chat. This Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use, process, and disclose your personal information when you use our website, applications, and services (collectively, “Services”). This Privacy Policy does not apply to content that we process on behalf of customers of our business offerings.

1. Scope and updates to this Privacy Notice

This Privacy Policy applies to personal information processed by us, including on our websites and other online or offline marketing or promotional campaigns. To make this Privacy Policy easier to read, our websites and other services are collectively called the “Services.”

We may provide additional privacy notices in writing to individuals at the time we collect their personal information. Any additional privacy notices may supplement this Privacy Policy or may apply in lieu of this Privacy Policy.


Important Note. This Privacy Policy does not apply to any of the personal information that we process on behalf of our customers through their use of our Services (“Customer Data”). Our customers’ respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with our customers, not this Privacy Notice. Any questions or requests relating to Customer Data should be directed to our customer.


Changes to our Privacy Notice. We may revise this Privacy Notice from time to time in our sole discretion. If there are any material changes to this Privacy Notice, we will notify you if required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Notice if you continue to participate in our Services after the new Privacy Notice takes effect.

2. Personal information we collect

We collect personal information relating to you (“Personal Information”) as follows:

A. Personal Information You Provide

We may collect personal information that you provide to us.

  • Account Information: When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials, payment card information, and transaction history, (collectively, “Account Information”).
  • User Content: When you use our Services, we collect Personal Information that is included in the input, file uploads, or feedback that you provide to our Services (“Content”). 
  • Communication Information: If you communicate with us, we collect your name, contact information, and the contents of any messages you send (“Communication Information”).
  • Social Media Information: We have pages on social media sites like Instagram, Facebook, Medium, Twitter, YouTube and LinkedIn. When you interact with our social media pages, we will collect Personal Information that you elect to provide to us, such as your contact details (collectively, “Social Information”). In addition, the companies that host our social media pages may provide us with aggregate information and analytics about our social media activity.
  • Other Information You Provide: We collect other information that you may provide to us, such as when you participate in our events or surveys or provide us with information to establish your identity (collectively, “Other Information You Provide”).

B. Personal Information Collected Automatically

We may collect personal information automatically when you use our Services.

  • Log & Usage Data. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet service provider. We may also automatically collect information regarding your use of our Services, pages you visit, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services. In addition, we may collect information on diagnostic information, including metadata based on information above, regarding the performance of the Services.
  • Analytics. We may use Technologies and other third-party tools to process analytics information on our Services. These Technologies allow us to better understand how our Services are used and to continually improve and personalize our Services.

3. How we use your personal information

We use your personal information for a variety of business purposes, including to provide our Services, for administrative purposes, and to market our products and Services, as described below.

A. Provide Our Services

We use your information to fulfill our contract with you and provide you with our Services, such as:

  • Managing your information (including opting-in and out of communications);
  • Providing access to certain areas, functionalities, and features of our Services;
  • Answering requests for information or technical support;
  • Communicating with your activities on our Services, and Notice changes;
  • Processing applications if you apply for a job we post on our Services; and allowing you to register for events.

B. Administrative Purposes

We use your information for various administrative purposes, such as:

  • Direct marketing;
  • Research and development (including marketing research);
  • Network and information security;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
  • Measuring interest and engagement in our Services;
  • Short-term, transient use, such as contextual customization of ads;
  • Improving, upgrading, or enhancing our Services;
  • Developing new products and services; and
  • Ensuring internal quality control and safety:

C. Other Purposes

We may use your personal information for other purposes as requested by you or as permitted by applicable law.

  • De-identified and Aggregated Information. We may use personal information to create de-identified and/or aggregated information, such as demographic information, information about the device from which you access our Services, or other analyses we create. If we create or receive de-identified information, we will not attempt to reidentify such information, except to comply with applicable law. In addition, we have implemented commercially reasonable technical safeguards and business processes to prohibit the reidentification of information.

4. How we disclose your personal information

We disclose your personal information to third parties for a variety of business purposes, as follows.

A. Disclosures to Provide our Services

The categories of third parties with whom we may disclose your personal information are described below.

  • Service Providers. We may disclose your personal information with our third-party service providers and vendors that assist us with the provision of our Services. This includes service providers that provide us with IT support, hosting, payment processing, customer service, and related services.
  • Business Partners. We may disclose your personal information with business partners to provide you with a product or service you have requested. We may also disclose your personal information with business partners with whom we jointly offer products or services.
  • Affiliates. We may disclose your personal information with our company affiliates for our administrative purposes, including activities such as IT management, for them to provide services to you or support and supplement the Services we provide.
  • Other Users or Third Parties. As described above in Section 2, our Services may allow you to disclose personal information or interact with other users and/or third parties (including individuals and third parties who do not use our Services and the general public).
  • Advertising Partners. We may disclose your personal information with third-party advertising partners. These third-party advertising partners may set Technologies and other tracking tools on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising.”

B. Disclosures to Protect Us or Others

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

A. Your Privacy Choices

The privacy choices you may have about your personal information are determined by applicable law and are described below.

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Privacy Notice).

Please note you must separately opt out in each browser and on each device.

B. Your Privacy Rights

In accordance with applicable law, you may have the right to:

  • Access your Personal Information and information relating to how it is processed.
  • Delete your Personal Information from our records.
  • Rectify or update your Personal Information.
  • Transfer your Personal Information to a third party (right to data portability).
  • Restrict how we process your Personal Information.
  • Withdraw your consent—where we rely on consent as the legal basis for processing at any time. 
  • Object to how we process your Personal Information.
  • Lodge a complaint with your local data protection authority.

If you would like to exercise any of these rights, please contact us as set forth in “Contact Us” below. We will process such requests in accordance with applicable laws.

6. Security of your information

We take steps to protect your information. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our Services, by mail, or by sending an email to you.

7. International data transfers

All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. While transferring your personal information internationally, we will comply with the applicable requirements governing processing of your personal information in a specific location – for example, your country of residence. We endeavor to safeguard your information consistent with the requirements of applicable laws.

8. Retention of personal information

Your personal data will be retained for as long as necessary for the purposes for which it was collected, which in most cases do not exceed 5 years. When Big Brain no longer needs to use your personal data to comply with contractual or statutory obligations, we will remove it from our systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it, unless we need to keep your information, including personal data, to comply with statutory retention periods, such as for tax, audit, or legal compliance purposes, for a legally prescribed time period thereafter, or if we need it to preserve evidence within statutes of limitation.

9. Supplemental notice for California residents

California Shine the Light. The California “Shine the Light” law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties.

10. Third-party websites or applications

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.

California Consumer Privacy Act Disclosures

This notice and policy (“CCPA Notice”) supplements information contained in the Privacy Notice (“Privacy Notice”) from Big Brain, LLC (“Company,” “us,” “we,” or “our”) and applies solely to residents of the State of California (“consumers” or “you”). Any terms defined in the California Consumer Privacy Act of 2018, as amended from time to time (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”) have the same meaning when used in this notice and policy. This notice and policy does not reflect our collection, use, or disclosure of California residents’ personal information, or data subject rights, where an exception under the CCPA applies. 1. Right to know about personal information collected and disclosed, and to request deletion of personal information

You have the right to request that we disclose what personal information we collect, use, or disclose about you specifically (“right to know”) and to request the deletion of personal information. To submit a request to exercise the right to know, please submit an email request to [info@big-brain.ai]. To submit a request to delete personal information, please submit an email request to [info@big-brain.ai].

Big Brain may ask that you provide certain information to verify your identity. The information that we ask you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue. Big Brain will respond to your request in accordance with the CCPA. If we deny your request, we will explain why.

When a business sells your personal information, you have a right to opt out of such sale. We do not sell, and in the preceding 12 months did not sell, the personal information of California residents. We do not have actual knowledge that it sells the personal information of minors under 16 years of age.

We may collect personal information when you: create a Big Brain account; make a purchase; communicate with us including when you request information about our Services, register for regular information updates, and request customer or technical support; participate in our surveys; make information available through our interactive features; transfer information to third party platforms, such as your social media platforms; and provide information while attending our webinars, or other events.
  • Third Parties, including Service Providers. We may collect personal information about you that you have made available via your privacy settings when you access our Services through a third-party application, such as an app store, a third party log-in service, or a social networking website. We may also collect personal information from service providers that we use to perform Services on our behalf or assist us with our provision of Services to you and from other third parties that we choose to collaborate or work with. Further, third parties, such as your friends, family, or co-worker, may provide information about you through our referral service.

Big Brain collects, uses, retains, and discloses your personal information for the purposes described below:

  • Establish your identity and verify the accuracy of your information.
  • Provide you with our services, including to: provide you access to our Services, applications, tools, and functionalities; process, maintain, and service your account(s); offer you enhanced functionalities when accessing our Services, including to keep track of your specified preferences, interests, or past items viewed; process your payments; identify and repair errors with our Services; provide you customer or technical support; allow you to register for our events; and enable service providers to perform the Services on our behalf of assist us with our provision of Services to you.
  • Manage user relationship and communications with you.
  • Handle and record consumer rights requests, including opt-ins and opt-outs.
  • Market our products and Services and provide personalized service or product recommendations to you.
  • Engage in research and development efforts to assess the performance of our Services, analyze activities, usage, interests, and trends in connection with our Services, improve and personalize our Services, and develop new products and services.
  • Assess and pursue potential business opportunities.
  • Audit interactions and transactions with you, identify irregular website behavior, and prevent fraud or other unauthorized or illegal activity.
  • Enforce our agreements and policies, comply with laws and regulatory requirements, and respond to lawful requests, court orders, and legal processes.
  • Create de-identified and/or aggregated information, such as demographic information and information about the device from which you access our Services . If we create or receive de-identified information, we will not attempt to re-identify such information, except to comply with applicable law.

3. Disclosure of personal information

Big Brain will disclose the above categories of personal information to the following categories of third parties for a business purpose, in some cases as directed by you:

  • Big Brain Affiliates and Business Partners. In particular, we may transfer your personal information to our affiliates for administrative purposes, including IT management, to provide Services to you, and to support and supplement the Services we provide. We may also transfer your personal information to business partners to provide you with a product or service you have requested or to jointly offer a product or service to you.
  • Third Parties, including Service Providers. In particular, we may use service providers to perform Services on our behalf or assist us with the provision of Services to you, including to provide us with IT support, hosting, payment processing, customer service, marketing, advertising, and related services. We may also transfer your personal information to third parties in connection with a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, as permitted by law and/or contract.
  • Government Regulatory Authorities. In particular, we may disclose your personal information to relevant government regulatory authorities if we believe the disclosure is reasonably necessary to comply with a law, regulation, or legal request. We may also transfer your personal information to third parties if we, in good faith, believe doing so is required to enforce our policies or contracts, collect amounts owed to us, assist us with an investigation or prosecution of a suspected or actual illegal activity, or to otherwise protect your, our, or others’ rights, property, or safety.

The right to have your Personal Information deleted. However, please be aware that we may not fulfill your request for deletion if we (or our service provider(s)) are required or permitted to retain your Personal Information for one or more of the following categories of purposes: (1) to complete a transaction for which the Personal Information was collected, provide a good or service requested by you, or complete a contract between us and you; (2) to ensure our website integrity, security, and functionality; (3) to comply with applicable law or a legal obligation, or exercise rights under the law (including free speech rights); or (4) to otherwise use your Personal Information internally, in a lawful manner that is compatible with the context in which you provided it.

Correction


You have the right to request that we correct any incorrect personal information that we collect or retain about you, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see below), we will correct (and direct any of our service providers that hold your data on our behalf to correct) your personal information from our records, unless an exception applies. We may deny your correction request if (a) we believe the personal information we maintain about you is accurate; (b) correcting the information would be impossible or involve disproportionate; or (c) if the request conflicts with our legal obligations.

To Opt Out of Sales or Sharing of Personal Information


The right to opt out of the sale or sharing of your Personal Information.

You may not be discriminated against because you exercise any of your rights under the CCPA in violation of California Civil Code § 1798.125.

If you would like to opt out of sharing or the sales of your Personal Information, you may email an opt-out request to privacy@bigbrain.ai. If you would like to limit the use of your sensitive Personal Information, you may submit your request to privacy@bigbrain.ai.

5. Authorized agent

You can designate an authorized agent to make a request under the CCPA on your behalf if:

  • The authorized agent is a natural person or a business entity registered with the Secretary of State of California and the agent provides proof that you gave the agent signed permission to submit the request; and
  • You directly confirm with Big Brain that you provided the authorized agent with permission to submit the request.

If you use an authorized agent to submit a request to exercise your right to know or your right to request deletion, please provide any information Big Brain requests to verify your identity. The information that Big Brain asks you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue.

If you provide an authorized agent with power of attorney pursuant to Probate Code sections 4121 to 4130, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.

7. Security

We use commercially reasonable efforts to protect the confidentiality and security of the personal data we process. However, despite these efforts to store personal data in a secure operating environment, we cannot guarantee the security of the personal data during its transmission or its storage on our systems. Furthermore, while we attempt to ensure the integrity and security of personal data, we cannot guarantee that our security measures will prevent third parties, such as hackers, from illegally obtaining access to it.

8. Changes to this notice

Please note that we may modify or update this CCPA Notice from time to time, so please review it periodically. We may provide you with an updated Notice if material changes are made. Unless otherwise indicated, any changes to this Notice will apply immediately upon posting to the Site.

Usage Policy

We want everyone to use our platform safely and responsibly. Which is why we’ve created usage policies that apply to all users of Big Brain’s, tools, and services. By following them, you’ll ensure that our technology is used for good.

If we discover that your product or usage doesn’t follow these policies, we may ask you to make necessary changes. Repeated or serious violations may result in further action, including suspending or terminating your account.

Our policies may change as we learn more about use and abuse of our services and tools.

Disallowed usage of our bots

We don’t allow the use of our bots for the following:

Illegal activity

  • Big Brain prohibits the use of our tools, and services for illegal activity.

Child Sexual Abuse Material or any content that exploits or harms children

  • We report CSAM to the National Center for Missing and Exploited Children.

Generation of hateful, harassing, or violent content

  • Content that expresses, incites, or promotes hate based on identity
  • Content that intends to harass, threaten, or bully an individual
  • Content that promotes or glorifies violence or celebrates the suffering or humiliation of others

Generation of malware

  • Content that attempts to generate code that is designed to disrupt, damage, or gain unauthorized access to a computer system.

Activity that has high risk of physical harm, including:

  • Weapons development
  • Military and warfare
  • Management or operation of critical infrastructure in energy, transportation, and water
  • Content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders

Activity that has high risk of economic harm, including:

  • Multi-level marketing
  • Gambling
  • Payday lending
  • Automated determinations of eligibility for credit, employment, educational institutions, or public assistance services

Fraudulent or deceptive activity, including:

  • Scams
  • Coordinated inauthentic behavior
  • Plagiarism
  • Academic dishonesty
  • Astroturfing, such as fake grassroots support or fake review generation
  • Disinformation
  • Spam
  • Pseudo-pharmaceuticals

Adult content, adult industries, and dating apps, including:

  • Content meant to arouse sexual excitement, such as the description of sexual activity, or that promotes sexual services (excluding sex education and wellness)
  • Erotic chat
  • Pornography

Political campaigning or lobbying, by:

  • Generating high volumes of campaign materials
  • Generating campaign materials personalized to or targeted at specific demographics
  • Building conversational or interactive systems such as chatbots that provide information about campaigns or engage in political advocacy or lobbying
  • Building products for political campaigning or lobbying purposes

Activity that violates people’s privacy, including:

  • Tracking or monitoring an individual without their consent
  • Facial recognition of private individuals
  • Classifying individuals based on protected characteristics
  • Using biometrics for identification or assessment

BigBrian’s platforms should not be used to triage or manage life-threatening issues that need immediate attention.

We have further requirements for certain uses of our tools:

  1. Consumer-facing uses of our tool in medical, financial, and legal industries; in news generation or news summarization; and where else warranted, must provide a disclaimer to users informing them that AI is being used and of its potential limitations.
  2. Automated systems (including conversational AI and chatbots) must disclose to users that they are interacting with an AI system. With the exception of chatbots that depict historical public figures, products that simulate another person must either have that person's explicit consent or be clearly labeled as “simulated” or “parody.”


SMS message length and character encoding

When you send an SMS message containing more than 160 characters, the message is split into smaller messages for transmission. Large messages are split into 153-character "segments" and sent individually, then re-assembled by the recipient’s device. The effective character limit per segment is 153 rather than 160, because a data header must be included with each segment to ensure correct re-assembly.

For example, a 161-character message will be sent as two messages: one with 153 characters and a second with eight characters.

If you include non-GSM-7 characters, such as Chinese script or emoji, in SMS messages, those messages have to be sent using the UCS-2 encoding. Messages containing one or more UCS-2 characters can contain up to 70 characters in a single, non-segmented message. UCS-2 messages of more than 70 characters will be split into 67-character segments.

Big Brain bills SMS for every message segment sent or received. For example, a 161-character message without UCS-2 characters will be sent and billed as two messages: one with 153 characters and a second with eight characters. UCS-2 messages of more than 71 characters will be billed as two messages: one with 67 characters and one with 4 characters.
